You're at the Tiger's game, or at a party.  You have a few drinks.  You're driving home, minding your own business. Then suddenly, you see the flashing lights in your rear view mirror - Oh, no! You're being pulled over for drinking and driving.  Did you have too many? You don’t feel drunk, but can you risk taking the tests?

Joe Long concentrates his practice in representing people like you who have been arrested for DWI. If your future is important to you, don’t leave your defense to a lawyer that does not focus the way we do. This area of the law is complicated and is in a constant state of change as lawmakers strengthen the penalties for DWI. You need a professional, fully versed in complicated issues such as these.

Driving while intoxicated (DWI) or driving while under the influence of alcohol or narcotics (DUI) is a serious offense. If anyone is injured by your actions, you may face serious criminal and even homicide charges.

If it's your first offense, and if no injury is involved, you may think the consequences may be as light as a fine and a suspended license or less. But make no mistake, prosecutors are doing everything possible to put even first-timers in jail these days.   If you take the breath test and register .15 or higher, you have to do jail time if convicted.  

Suspension or revocation of your license can last from 90 days to a year and a half, or perhaps even longer. The rules covering loss of license are too complicated to explain here. If you have questions, call us today.

Another consequence of DWI/DUI is the potential loss of your license. In Louisiana, if your blood alcohol content is more than .08%, the state requires the police officer to take your license immediately. If you refuse a breath test the officer will likewise take you license immediately, and your license is gone for six months. This can be reviewed, but you have to ask for a review immediately. In Louisiana you have 15 days from the date of arrest to request an administrative hearing in writing. If you miss the deadline, you will have no further chance of appeal.

Drunk Driving - Taking a Breathalyzer Test?

Refusal to take the breath test calls for a six-month revocation of driver's license or your privilege to drive. If you refuse a breath test, the police officer can confiscate your license on the spot and give you a 30-day permit.  You'll then have 15 days to contest the revocation of your license.

If you may have had too much to drink and are stopped by police:

  • Do not answer any questions. The police will use your answers to build their case against you.
  • You have the right to remain silent. Do so.
  • Don’t be disrespectful or argue with police. They are doing their jobs.
  • Ask for a lawyer immediately. Then quit talking.
  • Do not take the field sobriety test. It’s up to the officer who thinks you are drunk whether you pass.
  • Do not blow into the intoxilizer machine. Refuse all tests.

The housing provisions include requirement to allow service animals, and to provide or permit adaptations of the premises needed by disabled occupants as a reasonable accommodation. It is a violation of the Act for ANY PERSON to interfere with another's protected rights in housing.

In Public Accommodations...

...when, because of race, color, creed, religion, disability, national origin, sex:

A place of business, entertainment, transportation or other privately operated facility denies its premises or services, or discriminates in the access or use of them.

Public facilities must provide reasonable accommodations to make their premises and services accessible to persons who have disabilities.

Public accommodations must permit the use of recognized service animals by persons who have disabilities.

In Public Services...

...when, because of race, color, creed, religion, national origin, disability, sex, with regard to public assistance:

A facility or service operated by or on behalf of the government (including the state, counties, municipalities and regional agencies) denies or limits services or benefits, or fails to provide physical and program access;

A public transit service fails to provide physical access and equitable service to persons who have disabilities.

...when a trade, business, or service:

refuses to conduct business with a woman because of her choice of a surname;

or, because of race, color, national origin, sex, or disability, refuses to conduct business, provide a service, or contract with the owner or operator of the concern seeking to transact business, or discriminates in the terms, conditions, or performance of the arrangement.

Other Prohibited Practices

It is a violation of the Act to:

Require someone to commit an illegal act or take reprisal against someone who gives their employer notice that they will not participate of enforce and illegal policy.

Aid or abet another in committing illegal discrimination;

Take reprisal against a person for filing a charge, participating in an investigation, or opposing illegal discrimination;

Take reprisal against a person because of their association with persons who have disabilities or who are of a different race, color, creed, religion, sexual orientation or national origin.
